Terms of Service

By accessing or using Tutrl (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
These Terms are governed by the laws of New South Wales, Australia. Nothing in these Terms excludes, restricts, or modifies the application of the Australian Consumer Law where it applies.
1. Description of Service
Tutrl is a lesson tracking application for independent tutors. It provides tools for managing students, scheduling lessons, logging sessions, tracking payments, generating invoices, and creating parent recaps.
2. Accounts
- You must be at least 18 years old to use the Service.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must provide accurate, current, and complete information during registration.
- You are responsible for obtaining any necessary consents from your students or their parents or guardians before entering their information into the Service.
3. Billing, Subscriptions, and Refunds
- The Service is offered on a subscription basis at the published price.
- New accounts receive a 7-day free trial. You will not be charged during the trial period.
- If you cancel before the trial ends, you will not be charged.
- After the trial period, you will be billed monthly until you cancel.
- All prices are in Australian dollars (AUD) and include GST where applicable.
- You may cancel at any time. Upon cancellation, your account will remain active until the end of the current billing period.
- Payments are processed securely by a third-party payment provider. We do not store your payment card details.
- Refunds: If the Service has a major failure, you are entitled to a refund or replacement under the Australian Consumer Law. For minor failures, we will remedy the issue within a reasonable time. Refunds for change of mind are at our discretion.
4. User-Generated Content
The Service allows you to create, send, and manage content including lesson notes, emails to parents, invoices, and other communications (“User Content”). Some of this content may be generated with the assistance of artificial intelligence features within the Service.
- You retain full responsibility for all User Content you create, send, or distribute through the Service.
- We do not control, review, or endorse the content of any communications sent through the Service. You are solely responsible for ensuring your communications are accurate, appropriate, and comply with applicable laws.
- AI-generated content may contain errors or inaccuracies. You are solely responsible for reviewing, editing, and approving any AI-generated content before distributing it.
- We make no representations or warranties regarding the accuracy, completeness, or appropriateness of any User Content, including AI-generated content.
- We are not liable for any loss, damage, or claim arising from the use of User Content, including AI-generated content.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorised access to the Service or its systems
- Upload or store malicious content or code
- Use the Service to harass, abuse, or harm others
- Exceed reasonable usage limits as determined by us
- Use the Service in a way that could impair the experience of other users
6. Data Ownership
- You retain all ownership of the data you enter into the Service (student information, lesson notes, etc.).
- We do not claim ownership of your content.
- We may use anonymised, aggregated data for service improvement and analytics. This data cannot be used to identify you or your students.
- Upon account deletion, your data will be permanently deleted within 30 days, subject to any legal obligations to retain certain records.
7. Limitation of Liability
To the maximum extent permitted by law, including the Australian Consumer Law, Tutrl shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service. The Service is provided “as is” without warranty of any kind, except those that cannot be excluded under the Australian Consumer Law.
Where the Australian Consumer Law implies a non-excludable guarantee, our liability for breach of that guarantee is limited, at our option, to the resupply of the Service or the refund of fees paid.
8. Termination
- You may terminate your account at any time through your account settings.
- We reserve the right to suspend or terminate your account if you violate these Terms.
- Upon termination, you will lose access to the Service and your data will be deleted in accordance with our Privacy Policy.
9. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
10. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising out of or relating to these Terms or the Service shall be resolved in the courts of New South Wales.
